ElderGram AI - Terms of Service
These Terms of Service govern your use of the ElderGram AI mobile application, including AI greeting image generation, uploaded photos, generated content, credits, purchases, and related services.

These Terms of Service ("Terms") govern your use of the ElderGram AI mobile application, also known as 長輩圖AI or ElderGram AI (the "App"). By downloading, signing in, purchasing credits, uploading content, or generating images in the App, you agree to these Terms, our Privacy Policy, and our Content and Face Use Rules.

2. Service description
ElderGram AI is an AI-powered greeting image and 長輩圖 creation app. It lets you choose a greeting template or custom scene, enter greeting content, select text style, frame, decorative pattern, and image ratio, optionally upload a photo, and receive AI-generated greeting-card images. If you upload a photo, the App may process faces, likenesses, and visual features in that photo to generate the requested result.

You must be at least 13 years old to use the App. If you are under 18, you may use the App only with permission from a parent or legal guardian. Certain features may require signing in with Apple or another supported authentication method. You are responsible for maintaining the security of your account and for all activity that occurs through your App account. You agree to provide accurate account information and to notify us promptly if you suspect unauthorized access.

5. User content and generated content
You retain ownership of photos, prompts, greeting text, template choices, and other content you submit to the App ("User Content"). ElderGram AI does not claim ownership of your User Content or of AI-generated images you receive ("Generated Content"), except for the limited rights needed to operate the App.

To provide the App, you grant ElderGram AI a non-exclusive, worldwide, royalty-free license to host, process, transmit, temporarily store, and display your User Content and Generated Content solely to provide, secure, maintain, troubleshoot, and improve the App and related services. This includes storing User Content and Generated Content in private Supabase storage and sharing uploaded photos, prompts, greeting text, selected templates, text style, frame, pattern, image ratio, generated images, account identifiers, app version, locale, technical request data, and transaction information with Supabase, Apple, and BytePlus Seedream AI only as needed to deliver the service. We do not sell your photos or generated images.

You are solely responsible for all User Content you submit, all greeting text and prompts you enter, and all Generated Content you save, share, publish, distribute, sell, or otherwise use. ElderGram AI provides creative tools only. We do not control, endorse, adopt, or approve your uploads, prompts, greeting text, or Generated Content.

AI generation is automated and unpredictable. Generated Content may be inaccurate, unintended, offensive, visually distorted, similar to content created for others, or resemble real people, places, brands, symbols, or works without being authentic. You use the App and any Generated Content at your own risk.

You must not use the App to create, upload, request, or distribute content that is illegal, deceptive, harassing, hateful, sexually explicit, violent, exploitative, infringing, privacy-invasive, or otherwise harmful. This includes non-consensual deepfakes, impersonation, misleading images of real people, images of minors in inappropriate contexts, nudity, and content that violates third-party intellectual property, privacy, publicity, or defamation rights.
You must not use the App to create, upload, request, or distribute content that is illegal, deceptive, harassing, hateful, sexually explicit, violent, exploitative, infringing, privacy-invasive, or otherwise harmful. Generated Content is provided for entertainment, greeting, and creative expression only. It is not medical, legal, identity, employment, financial, or official advice or documentation. You must not rely on Generated Content for decisions that could affect health, safety, legal rights, reputation, employment, finances, or official status.

We may use automated and manual safeguards to detect or prevent abuse, but we do not guarantee that every prohibited request, upload, or output will be detected or blocked. We may refuse generation requests, block, remove, or restrict content or accounts that violate these Terms, our Content and Face Use Rules, applicable law, or safety requirements.

We may apply usage limits, including generation limits, queue limits, file size limits, account limits, or credit limits, to protect service quality and prevent abuse. We may modify, suspend, or discontinue any part of the App at any time.

ElderGram AI relies on third-party services to operate, including Supabase for authentication, database, and private storage, Apple for App Store purchases, and BytePlus Seedream AI for AI image generation. Uploaded photos, prompts, greeting text, selected templates, text style, frame, pattern, image ratio, generated images, account identifiers, app version, locale, technical request data, and transaction information may be processed by these providers only as needed to deliver the App. We are not responsible for interruptions, outages, errors, price changes, policy changes, or service restrictions caused by third-party services, and we may change providers without prior notice.

The App may offer paid consumable credits or credit packages. Credits are used to request image generations or other paid App features. Unless the App states otherwise, one successful image generation consumes one credit. We may change the number of credits required for a feature, the available packages, prices, promotions, or free credit offers at any time for future purchases or future use.

Purchases are processed by Apple through the App Store or by another payment provider shown at checkout. Prices, taxes, currency, payment methods, receipt handling, and refund workflows may be controlled by the applicable store or payment provider. Credits are digital consumables. Credits have no cash value, are not a bank account or stored-value instrument, are not transferable, and may not be sold, exchanged, assigned, or redeemed for money except where required by law. Credits may be tied to your App account and may not be available if you delete your account, lose access to your account, violate these Terms, or if the App is discontinued.

18. Refunds and failed generations
Except where required by law or by App Store rules, purchases are final and non-refundable once completed. Refund requests for App Store purchases must be submitted through Apple. If a generation fails because of a service error before an image is produced, we may automatically refund the consumed credit to your App balance or otherwise restore the credit at our discretion. We do not refund credits for dissatisfaction with creative results, user mistakes, unsuitable prompts, policy rejections, deleted results, account violations, or downstream use decisions.

20. Taxes, chargebacks, and abuse
You are responsible for all taxes and charges associated with your purchases. We may suspend or restrict accounts involved in payment fraud, unauthorized purchases, chargebacks, refund abuse, credit farming, or attempts to manipulate credit balances.

You may stop using the App at any time. You may delete generation history in the App where that feature is available. We may suspend or terminate access if you violate these Terms, fail to pay amounts owed, abuse credits or refunds, or if needed to protect users, the service, payment integrity, or legal compliance.

THE APP, CREDITS, AND ALL GENERATED CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, ELDERGRAM AI DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, ORIGINALITY, AVAILABILITY, AND THAT GENERATED CONTENT WILL BE LAWFUL OR SUITABLE FOR YOUR INTENDED USE.

TO THE FULLEST EXTENT PERMITTED BY LAW, ELDERGRAM AI AND ITS OPERATORS, AFFILIATES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, CREDITS, PROFITS, GOODWILL, REPUTATION, OR BUSINESS OPPORTUNITY, ARISING FROM OR RELATED TO YOUR USE OF THE APP, YOUR USER CONTENT, YOUR PROMPTS, YOUR PURCHASES, OR ANY GENERATED CONTENT, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

You agree to defend, indemnify, and hold harmless ElderGram AI and its operators, affiliates, and service providers from and against any claims, demands, losses, liabilities, damages, costs, and expenses, including reasonable legal fees, arising from or related to: (a) your User Content, greeting text, or prompts; (b) your Generated Content or how you use, share, publish, distribute, or commercialize it; (c) your purchases, payment disputes, or misuse of credits; (d) your violation of these Terms, our Content and Face Use Rules, or applicable law; or (e) your infringement of any third party's rights.
