Alano - Terms of Service
These Terms of Service govern your download, installation, access, and use of Alano, a mascot library, sticker pack, and mascot generation app operated by Alano Tech Pte. Ltd. They cover what you may create and publish, the license under which the Alano character is made available, and, for copies obtained through the Apple App Store, they serve as the Licensed Application End User License Agreement in place of Apple’s standard EULA.
A. Agreement Relationship
These Terms of Service (“Terms”) govern your download, installation, access, and use of the Alano mobile application, website, and related services (collectively, the “Service”), operated by Alano Tech Pte. Ltd. (“Developer”, “we”, “our”, or “us”). By accessing or using Alano, you agree to be legally bound by these Terms. If you do not agree, you should immediately discontinue use of the Service.

The Service may be distributed through third-party platforms, including the Apple App Store and Google Play Store. Your download and use of the App is also subject to the applicable terms, conditions, and usage rules of those platforms, including the Apple Media Services Terms and Conditions. For copies obtained through the Apple App Store, these Terms constitute the Licensed Application End User License Agreement between you and Alano Tech Pte. Ltd. and apply in place of Apple’s standard End User License Agreement, as set out in Sections R and S below.

Alano provides a searchable library of artwork featuring the Alano mascot character, tools to assemble that artwork into sticker packs and export them to third-party chat applications, and an optional feature that generates new mascot artwork from a short description you write. We may modify, suspend, discontinue, or update any aspect of the Service at any time without prior notice.

D. Eligibility
You must be at least 13 years old to use the Service. If you are under the age of majority in your jurisdiction, you should use the Service only with the consent of a parent or legal guardian. By using Alano, you represent that you have the legal authority and capacity to enter into these Terms and that your use complies with applicable laws and regulations.

E. Anonymous Access and Accounts
Browsing the library, building sticker packs, and exporting them do not require you to register, sign in, or provide any personal information. The App creates an anonymous session on your device solely to enforce the daily generation limit and to associate published creations with the device that made them. You are responsible for activity that occurs through your device.

Generating a mascot consumes computing resources that we pay for, so the number of generations available to one device per day is limited. A generation that completes counts against your daily limit whether or not you choose to publish the result, because the cost has already been incurred by the time you see it. If a generation fails on our side, or the resulting artwork cannot be processed to a usable standard, we return the allowance to you.

You represent that your submission does not infringe the intellectual property, privacy, publicity, or other rights of any person, and does not contain personal information about you or anyone else.

H. Prohibited Content and Acceptable Use
You must not use the Service to create, publish, or attempt to create content that is sexually explicit, violent, hateful, harassing, defamatory, discriminatory, deceptive, or otherwise objectionable; that depicts or references illegal activity; that impersonates or targets a real person or organization; that infringes anyone’s rights; or that is intended to circumvent our content filters. You also agree not to reverse-engineer, decompile, interfere with, overload, bypass technical restrictions of, or use automated means such as bots, crawlers, or scrapers against the Service, and not to harvest the library at scale.

Alano Tech Pte. Ltd. retains copyright, trademark, and all intellectual property ownership of the Alano character. Subject to that, the mascot artwork made available through the Service — including artwork you generate — is provided under the Free Mascot License, which permits use in commercial products, indie apps and side projects, AI products, and hackathons, free of charge. You may not resell the assets themselves as a standalone asset pack, template, or stock library; claim that you created the Alano character; mint or sell Alano as an NFT; or use Alano in offensive, hateful, or illegal contexts. This license does not transfer ownership of the character and grants no right to imply endorsement by or partnership with Alano Tech Pte. Ltd.

The App itself, its source code, interface design, database structure, taxonomy, written copy, and the organization and selection of the library are owned by us or our licensors and are protected by applicable intellectual property laws. N. AI-Generated Output
Artwork produced by the generation feature is created automatically by a third-party AI model. It may be inaccurate, unexpected, inconsistent with your description, or unsuitable for your purpose, and we do not guarantee any particular result, quality, or turnaround time. Output is not unique: other users writing similar descriptions may receive similar artwork, and we make no representation that any creation is original or exclusive to you.

O. Sticker Packs and Third-Party Chat Applications
Exporting a pack hands it to WhatsApp, Telegram, or another application on your device, which then asks you to complete the installation. Those applications do not report the outcome back to us, so we cannot confirm that a pack installed successfully. Chat applications also cannot update a pack in place, so editing a pack after installing it produces a new pack rather than changing the existing one. Your use of those applications is governed by their own terms, not ours.

Sticker packs, the publisher name you set, and your other App preferences are stored only on your device. We are not able to back them up, recover them, transfer them, or restore them on your behalf if you delete the App, reset your device, switch devices, or otherwise lose access to your device.

Q. Third-Party Services
The Service relies on third-party providers, including backend, database, storage, and authentication hosting, and AI image generation. These providers currently include Supabase and BytePlus. We are not responsible for interruptions, outages, errors, delays, quality issues, policy changes, or data handling practices caused by third-party services, and we may change providers at any time without prior notice.

R. Scope of License
Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to download, install, and use the Alano application on any Apple-branded products that you own or control, and as permitted by the Usage Rules set out in the Apple Media Services Terms and Conditions, except that Alano may be accessed and used by other accounts associated with you via Family Sharing or volume purchasing. On other platforms, the equivalent license applies to devices that you own or control, subject to that platform’s usage rules. You may not sublicense, rent, lease, lend, sell, redistribute, decompile, reverse-engineer, disassemble, or attempt to derive the source code of the App, nor commercially exploit the App or the Service. This license is separate from, and does not limit, the Free Mascot License that applies to the artwork.

S. End User License Agreement — Terms Required by Apple
If you obtained Alano through the Apple App Store, these Terms serve as the Licensed Application End User License Agreement between you and Alano Tech Pte. Ltd., and replace Apple’s standard End User License Agreement. The following terms are required by Apple and apply in addition to the remainder of these Terms; where this section conflicts with the remainder of these Terms in respect of the Apple App Store, this section prevails.
(1) Acknowledgement. These Terms are concluded between you and Alano Tech Pte. Ltd. only, and not with Apple. Alano Tech Pte. Ltd., not Apple, is solely responsible for the App and its content. Apple is not a party to these Terms.
(2) Maintenance and Support. Alano Tech Pte. Ltd. is solely responsible for providing any maintenance and support services in respect of the App, as specified in these Terms or as required under applicable law. Apple has no obligation whatsoever to furnish any maintenance and support services in respect of the App.
(3) Warranty. Alano Tech Pte. Ltd. is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any, of the App to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be the sole responsibility of Alano Tech Pte. Ltd.
(4) Product Claims. Alano Tech Pte. Ltd., not Apple, is responsible for addressing any claims by you or any third party relating to the App or your possession and use of the App, including but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.
(5) Intellectual Property Rights. In the event of any third-party claim that the App or your possession and use of the App infringes that third party’s intellectual property rights, Alano Tech Pte. Ltd., not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.
(6) Legal Compliance. You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
(7) Third Party Terms. You must comply with applicable third-party terms of agreement when using the App, including the terms of any chat application to which you export a sticker pack.
(8) Third Party Beneficiary. Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will have the right, and will be deemed to have accepted the right, to enforce these Terms against you as a third-party beneficiary of these Terms.
(9) Developer Contact. Questions, complaints, or claims with respect to the App should be directed to Alano Tech Pte. Ltd., Singapore, hello@alano.ai.

THE SERVICE AND ALL CONTENT, INCLUDING THE LIBRARY, ANY GENERATED ARTWORK, AND ANY EXPORTED STICKER PACK, ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AVAILABILITY, NON-INFRINGEMENT, OR UNINTERRUPTED OPERATION, TO THE FULLEST EXTENT PERMITTED BY LAW. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE SECURE, ERROR-FREE, AVAILABLE AT ALL TIMES, OR FREE FROM VULNERABILITIES OR HARMFUL COMPONENTS.

THIS INCLUDES LOSS OF DATA, INCLUDING LOCALLY STORED STICKER PACKS AND PREFERENCES, LOSS OF PROFITS, LOSS OF BUSINESS OPPORTUNITIES, LOSS OF GOODWILL, OR OTHER INTANGIBLE LOSSES.
