Chole B - Terms of Use
These Terms of Use govern Chole B, its Apple App Store distribution, AI companion chat, AI image generation, subscriptions, uploaded photos, and generated content.

These Terms of Use govern your use of the Chole B mobile application and related services. By installing or using Chole B, creating an account, chatting, purchasing a subscription, uploading content, or requesting an AI-generated image, you agree to these Terms, the Privacy Policy, and the Content and Face Use Rules.

2. Apple App Store EULA
For downloads through the Apple App Store, Apple’s Standard Licensed Application End User License Agreement applies when no valid custom EULA is configured in App Store Connect. If a valid custom EULA is configured, it governs the App Store license. These Terms include the Apple acknowledgements required for a custom EULA. 3. License to use Chole B
Subject to these Terms, Omu Labs grants you a personal, limited, non-exclusive, non-transferable, revocable license to use Chole B on Apple-branded devices that you own or control, as permitted by the applicable Apple Media Services usage rules. You may not rent, lease, sell, redistribute, sublicense, reverse engineer, or make the App available to others except as permitted by law.

5. AI service disclosure
Chole B is an AI companion and creative image service, not a human or a licensed professional. It may use AI model providers including OpenAI, BytePlus, and Alibaba. Specific models and providers may change. AI responses and images are automated and may be inaccurate, incomplete, biased, offensive, visually distorted, or similar to other generated content.

6. User Content and Generated Content
You retain rights you hold in your messages, prompts, photos, preferences, and other content you submit (User Content). You also retain rights you may have in images generated for you (Generated Content), subject to third-party rights and these Terms. We receive only the limited license needed to host, process, transmit, store, moderate, display, secure, troubleshoot, and improve the service.

7. Photos, faces, and consent
You may upload only content you own or have the legal right and explicit permission to use. Before using another identifiable person’s face, body, voice, identity, or likeness, you must obtain their informed permission. You are responsible for obtaining all permissions required for your intended use.

You must not use Chole B to create, request, upload, or distribute illegal, deceptive, harassing, hateful, sexually explicit, violent, exploitative, privacy-invasive, infringing, or otherwise harmful content. This includes non-consensual intimate imagery, sexual deepfakes, impersonation, fraud, misleading depictions of real people, and inappropriate or exploitative content involving minors.

To provide requested features, we may process relevant data through Supabase for authentication, database, Edge Functions, and private storage; OpenAI, BytePlus, and Alibaba for AI capabilities; and Apple for App Store distribution and purchases. Providers may process only the information needed for their service under their applicable terms and data-processing practices. We may change providers or models as the service evolves.

Prices, billing periods, taxes, renewal, trial, grace-period, cancellation, and refund terms shown at purchase are controlled by the App Store offer and Apple’s applicable terms. We may receive limited purchase and entitlement information to provide access. Unused allowances do not roll over unless the App expressly says otherwise.

11. Apple acknowledgements
Omu Labs, not Apple, is responsible for Chole B, its content, and any maintenance, support, product-liability, regulatory, or intellectual-property claims relating to it, to the extent required by law. Apple has no obligation to provide maintenance or support. If the App fails to conform to an applicable warranty, you may notify Apple and Apple may refund the purchase price, if any; to the maximum extent allowed by law, Apple has no further warranty obligation. Apple and its subsidiaries are third-party beneficiaries of this EULA and may enforce it against you.

Chole B and Generated Content are provided AS IS and AS AVAILABLE. To the fullest extent permitted by law, Omu Labs disclaims implied warranties and is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or loss of data, profits, reputation, or opportunity. Mandatory consumer rights are not excluded.
